Terms of Conditions
1. General Information
These terms and conditions apply to all agreements entered into with Nikki's Fine Arts, hereinafter referred to as "the Artist," for the creation of custom animal portraits. By placing an order, the client agrees to these terms.
2. Ordering and Payment
Order Process: Orders for animal portraits are placed via the website or email. The client will receive an order confirmation with details about the project and costs.
Deposit: A non-refundable deposit is required upon placing an order. This deposit amounts to €150 - 50% of the total cost. The remaining balance is due upon completion of the portrait.
Payment: Payments can be made via bank transfer, PayPal . The Artist will begin work after receiving the deposit and when it's the clients time on the waitlist.
3. Cancellation
If the client cancels an order, the paid deposit is non-refundable. This compensates for the time and resources already invested by the Artist.
Cancellations must be communicated in writing (via email) to info@nikkisfinearts.com.
4. Delivery
The delivery time for an animal portrait will be agreed upon with the client and depends on the project's complexity and the Artist's workload.
The Artist strives to deliver the portrait within the agreed timeframe but cannot be held liable for delays due to unforeseen circumstances.
The completed portrait will be delivered physically shipped to the address provided by the client.
5. Revisions and Approval
The client must approve the completed portrait before it is considered final.
6. Copyright and Usage
The Artist retains the copyright to all created portraits. The client receives a license for personal, non-commercial use.
Reproduction, distribution, or commercial use of the portrait without the Artist’s written permission is prohibited.
The Artist reserves the right to use images of the portraits for promotional purposes, such as on the website or social media, unless otherwise agreed.
7. Liability
The Artist is not liable for damage to or loss of the portrait during shipping, provided the shipment is insured.
The Artist strives for high quality but cannot be held liable for the client’s subjective dissatisfaction with the artistic result.
8. Disputes
This agreement is governed by Belgium law.
Disputes will first be resolved through mutual consultation. If this is not possible, disputes will be submitted to the competent court in Belgium.
Privacy Policy

Nikki's Fine Arts values the privacy of its clients. This privacy policy outlines how we handle personal information collected in the course of our services.

Name, address, and contact details (email address, phone number) for processing orders and communication.
Photos or other references of animals provided for creating the portrait.
Payment details, such as bank account numbers, for processing payments.

4. Data Retention
Personal information is retained for as long as necessary to fulfill the agreement and comply with legal obligations (e.g., tax regulations).
Photos and portraits may be retained for portfolio and promotional purposes unless the client objects.
5. Sharing of Data
Personal information is not shared with third parties except when necessary to fulfill the agreement (e.g., with a shipping service) or to comply with legal obligations.
If portraits are used for promotional purposes, no personal client information will be shared without explicit consent.
6. Security
We implement appropriate technical and organizational measures to protect personal information against unauthorized access, loss, or theft.
Data is stored on secure servers, and payments are processed through secure payment services.
7. Client Rights
Clients have the right to access, correct, or request deletion of their personal information, provided this does not conflict with legal obligations.
Requests for access, correction, or deletion can be submitted via info@nikkisfinearts.com.
Clients have the right to object to the use of their portraits for promotional purposes.
